1 Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the NYAM mobile application ("the App") and our website at nyamapp.co.uk ("the Website"), operated by NYAM App Ltd ("NYAM", "we", "us", "our"), a company registered in England and Wales under company number 17118391 with registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. NYAM App Ltd is registered with the Information Commissioner's Office under registration number ZC122949.
By downloading, installing or using the App or Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App or Website.
These Terms should be read alongside our Privacy Policy, which is incorporated by reference.
2 About the App
NYAM is a food information application that provides food scores, nutritional information and educational content relating to food products. The App lets you:
- Scan product barcodes (including offline scanning — barcodes are queued and processed when your device returns online)
- Import supermarket receipts or order-confirmation emails to score a full shop
- Paste basket text to review an order before confirming it
- Search a database of 165,000+ UK food products
- View NYAM scores based on Nutri-Score, NOVA processing group, additives and pesticide risk, optionally personalised by your food priorities
- Compare two products side by side
- Share product scores and comparisons
- Access AI-generated score explanations, Smarter Swap suggestions and shop analysis reports (subject to subscription tier and usage limits)
- Contribute to the public NYAM catalogue by submitting product images, nutrition label photos and nutritional values, subject to moderator review
The App uses data from publicly available third-party sources and applies its own scoring methodology to present information to you. NYAM is an information tool only. It is not a medical device, a healthcare service, a dietetic service or a substitute for professional nutritional, medical or dietary advice.
3 Eligibility, Accounts and Email Confirmation
3.1 Age (18+ only)
The App is intended for adults aged 18 and over only. NYAM is not directed at children, is not marketed to children and is not designed for use by anyone under 18. By using the App you confirm that you are at least 18 years old. You must not use the App, create an account or submit any content if you are under 18. If we become aware or have reasonable grounds to believe that a user is under 18, we may suspend or terminate that use or account and delete any associated data. This age restriction is a condition of using the App and is intended to keep the App outside the scope of services aimed at, or likely to be accessed by, children.
3.2 Anonymous use
You can use the core features of the App (barcode scanning, search, product detail, scoring, shopping lists) without creating an account. On first launch NYAM assigns a random anonymous identifier; no email or other contact detail is required. Anonymous use is subject to these Terms and our Privacy Policy in the same way as signed-in use.
3.3 Signed-in accounts
You can optionally create a NYAM account by providing your email address, choosing a password and (optionally) a first name. We require email confirmation before sign-in. A confirmation link will be sent to the email address you provide; you must click that link before you can sign in.
A signed-in account preserves your data across devices and is required if you wish to opt in to marketing emails (see our Privacy Policy). If you upgrade from anonymous use to a signed-in account, your existing in-app data is preserved against the same identifier.
You are responsible for the accuracy of the information you provide when creating an account, for keeping your account credentials confidential and for all activity that takes place under your account. Please notify us immediately at hello@nyamapp.co.uk of any suspected unauthorised use.
4 Important Health and Nutritional Disclaimers
Please read this section carefully. It contains important limitations on the nature of the information provided by NYAM.
4.1 Not medical or dietary advice
The information, scores, ratings and content provided by the App ("NYAM Content") are for general informational and educational purposes only. NYAM Content does not constitute:
- Medical advice
- Dietary advice
- Nutritional advice
- Health advice
- A diagnosis, treatment or prevention of any disease or health condition
- A recommendation to purchase or avoid any specific food product
You should always consult a qualified healthcare professional, registered dietitian or nutritionist before making significant changes to your diet, particularly if you have any medical condition, allergy, food intolerance or specific dietary requirement.
4.2 Accuracy of information — third-party data sources
NYAM sources product and nutritional data from third-party databases including, but not limited to:
- Open Food Facts — an open-source community-contributed database of food products
- Pesticide Action Network UK (PAN UK) — for UK-specific pesticide data
- European Food Safety Authority (EFSA) — for food additive safety evaluations
- Nutri-Score (Santé Publique France) — for nutritional grading methodology
- NOVA Classification (University of São Paulo) — for food processing classification
NYAM does not independently verify the accuracy, completeness or currency of data obtained from these third-party sources. Third-party data may be incomplete, out of date, inaccurate, inconsistent across sources, or subject to change without notice. NYAM makes no warranty, express or implied, as to the accuracy, reliability, completeness or suitability of any data displayed in the App.
4.3 NYAM scoring methodology
The NYAM Score is a proprietary composite score calculated by NYAM App Ltd using publicly available data and NYAM's own methodology. The NYAM Score:
- Is not endorsed by any government body, health authority or regulatory organisation
- Is based on data that may be incomplete or inaccurate
- Reflects NYAM's methodology at the time of calculation and is subject to change
- Should not be the sole basis for any dietary or purchasing decision
- May differ from official guidance issued by the NHS, Food Standards Agency or other authorities
Personalised scores reflect your own stated priorities and are generated algorithmically. They do not represent professional dietary advice tailored to your specific health circumstances.
4.4 User-set score overrides
Premium subscribers may override the NYAM Score for any product with a user-set score. User-set scores:
- Are set entirely at the user's own discretion and reflect that user's personal assessment only
- Override the algorithmically calculated NYAM Score completely
- Do not represent NYAM's assessment of the product's nutritional quality
- Should not be relied upon by other users or treated as objective product assessments
Anonymised aggregated user score data (barcode, score and stated reason only) may be used by NYAM to review and calibrate the NYAM scoring system where multiple users assign significantly divergent scores to the same product. No personally identifiable information is stored in connection with score overrides.
4.5 Pesticide, PFAS and additive data
Information relating to pesticide residues, PFAS (per- and polyfluoroalkyl substances) and food additives is provided for general educational awareness only. This information:
- Is based on third-party research and publicly available data
- Does not represent a guarantee that any specific product contains or does not contain any specific substance
- Does not account for individual sensitivity, tolerance or medical conditions
- Should not be relied upon by persons with specific health conditions, allergies or medical requirements without independent professional verification
The presence of a product on the Dirty Dozen list does not mean that the product is unsafe for consumption. These classifications reflect general pesticide residue data and are not product-specific test results.
4.6 Allergen information
NYAM does not provide reliable allergen information and must not be used as a basis for allergen avoidance decisions.
Allergen data that may appear in the App is sourced from third-party databases and may be incomplete, inaccurate or out of date. If you or someone in your care has a food allergy or intolerance, you must:
- Read the product label on the physical product every time before consumption
- Contact the manufacturer directly for current allergen information
- Consult a qualified healthcare professional
NYAM expressly excludes all liability for any harm, injury or adverse reaction resulting from reliance on allergen information displayed in the App.
4.7 AI-generated content
Certain features of the App use artificial intelligence (AI) provided by Anthropic (Claude AI) to generate content, including:
- NYAM score explanations (AI explanations of why a product scored as it did)
- Smarter Swap suggestions
- Shop analysis reports
- Receipt and basket parsing in the Score My Shop and Score Basket features
AI-generated content is generated automatically, has not been reviewed by a qualified professional, may contain errors or inaccuracies, and should not be relied upon as professional advice. NYAM does not warrant the accuracy, appropriateness or suitability of any AI-generated content.
4.8 Receipt import, basket review and product matching
The Score My Shop feature allows you to import supermarket receipts or order-confirmation emails (via PDF upload or text paste) to score a full shop. The Score Basket feature allows you to paste basket text to review an order before confirming it. Both features use automated product matching which:
- May result in incorrect product matches, including cross-supermarket matches
- May fail to match some products
- Should be verified by you before relying on any matched product information
NYAM does not warrant that matched products accurately reflect the products purchased or in the user's basket.
5 Subscriptions and Payments
5.1 Subscription tiers
The App offers two subscription tiers. Current pricing is also displayed in the App and on nyamapp.co.uk. Prices are in pounds sterling (GBP) and inclusive of any taxes added by the relevant app store at checkout.

Note on the AI explanations and Smarter Swaps allowances: AI explanations and Smarter Swap suggestions each have their own separate monthly allowance of 30 uses on Premium (up to 60 AI actions per month in total). Each AI explanation request counts against the explanations allowance, and each Smarter Swap request counts against the Smarter Swaps allowance.
5.2 Billing, app store and renewal
Subscriptions are billed through the relevant app store (the Google Play Store on Android and the Apple App Store on iOS). Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your app-store account on confirmation of purchase and at each renewal. NYAM does not process payments directly and does not store payment-card information. For annual subscriptions, we will send you an in-app reminder in advance of each automatic renewal so that you can decide whether to continue or cancel before payment is taken.
5.3 Free trial
Where you are eligible, a 1 month free trial of the Premium tier is offered. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically renew at the standard Premium price and payment will be charged. We will send you an in-app reminder before your free trial ends and your subscription converts to a paid subscription, so that you have the opportunity to cancel if you do not wish to be charged. Eligibility for the free trial is determined by the relevant app store and may be available only once per user / per payment account.
5.4 Cancellation and refunds
You may cancel your subscription at any time through your app-store account settings. Cancellation takes effect at the end of the current billing period and you will retain access to Premium features until that date. Refunds are subject to the relevant app store's refund policy. NYAM does not issue refunds directly. Nothing in this section affects your statutory rights. Where you have a legal right to cancel a purchase and obtain a refund (including, for paid purchases made as a consumer, the 14-day right to cancel a distance contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to the exceptions in those Regulations), that right is unaffected. Because billing is handled by the relevant app store, you may need to exercise any such right through the app store; if you are unable to do so, please contact us at hello@nyamapp.co.uk and we will assist.
5.5 Price changes
We reserve the right to change subscription prices. We will provide reasonable notice in advance of any price change. If you do not accept a price change, you can cancel your subscription before the change takes effect. Continued use of a subscription after a price change takes effect constitutes acceptance of the new price.
5.6 Usage limits
Each subscription tier includes the monthly usage limits set out below. Limits apply per calendar month and reset on the first day of each calendar month. Unused allowances do not carry over.

NYAM reserves the right to modify usage limits with reasonable notice.
5.7 Restoring purchases
If you reinstall the App or switch devices, you can restore an active subscription using the Restore Purchases option in the App. Restoration is handled by the relevant app store and our subscription provider; we do not retain a copy of your payment card or your app-store identity.
6 User Submissions to the Catalogue
The App lets you submit information to help improve the public NYAM catalogue. The types of submission are:
- A product image — a photo of the front of a product so other users can identify it in scan and search results
- A nutrition label photo — a photo of the back-of-pack nutrition information so a moderator can verify the values you submit
- Publicly available nutritional data — the per-100g values printed on the product packaging (energy, fat, saturated fat, sugar, salt, protein, etc.), plus product name, brand and category
6.1 Moderator review and no-identifying-information policy
Every submission is reviewed by a NYAM moderator before it is published. Submitted images are intended to capture the product, not the contributor. You must make sure that any photo you submit does not contain anything that could identify you or anyone else — including faces, hands, household surroundings, address labels, receipts, screens or other personal context. NYAM will reject any image that is found to contain identifying information. Rejected images are deleted and do not become part of the public catalogue.
NYAM may also reject any submission that is inaccurate, of insufficient quality, contains third-party content the contributor does not have the right to use, is unlawful, or otherwise unsuitable for the public catalogue. NYAM's decision on whether to accept or reject a submission is final.
6.2 Treatment of submitted nutritional data
Nutritional values, product name, brand and category in a submission are publicly available information printed on commercial product packaging. They are treated as product data rather than your personal data. Once approved, this data is added to the public NYAM catalogue and may be displayed to other users.
6.3 Licence you grant to NYAM
By submitting a product image, a nutrition label photo or nutritional data to the App, you grant NYAM a worldwide, royalty-free, non-exclusive licence to store, reproduce, modify (including for moderation, correction and accessibility), display and publish that submission as part of the NYAM catalogue and for the purpose of operating, maintaining and improving the App, the Website and the NYAM service. This includes the right to make the submission available to other users of the App and Website so that they can use the catalogue, and to use sub-contractors and service providers (such as our hosting and moderation providers) to host and process the submission on our behalf for these purposes. We will not sell or license your submissions to third parties for their own independent commercial use. This licence lasts for as long as the submission remains part of the catalogue; if you ask us to remove a submission and we do so, the licence ends in respect of that submission, except for the limited rights described in section 6.5.
6.4 Your warranties about submissions
When you submit content to the catalogue, you warrant that:
- You took the photograph yourself (or otherwise have all rights necessary to grant the licence above)
- The submission does not contain identifying information about you or any other person
- The submission does not infringe any third-party intellectual property right, right of privacy or other right
- Any nutritional values, product name, brand and category you submit accurately reflect the information printed on the product packaging
- You are not submitting the content in breach of any contract, court order or applicable law
You remain responsible for any content you submit. NYAM may remove any submission at any time and may suspend or terminate access to the App in the event of repeated or serious breach of these warranties.
6.5 Removal of submissions after publication
If you delete your account or use the Delete My Data feature, the submitter identifier linked to your submissions is removed in line with our Privacy Policy. Submissions that have already been approved and added to the public catalogue may, however, remain in the catalogue thereafter as anonymised product data. If you believe a published submission must be removed (for example because it contains identifying information you did not notice at the time), please email hello@nyamapp.co.uk and we will review the submission and remove it where appropriate.
7 User Responsibilities
By using the App, you agree that you will:
- Use the App for personal, non-commercial purposes only (unless otherwise agreed in writing)
- Not attempt to reverse engineer, decompile or otherwise extract the source code of the App
- Not use the App to transmit harmful, offensive or unlawful content
- Not attempt to gain unauthorised access to any part of the App or its infrastructure
- Not scrape, harvest or otherwise extract data from the App for commercial purposes
- Provide accurate information where required (including in any account registration and in any catalogue submission)
- Keep your account credentials confidential and notify us immediately of any suspected unauthorised use of your account
- Take sole responsibility for any user-set score overrides you apply, acknowledging that these override the NYAM calculated score and reflect your personal assessment only
- Verify product matches when using the Score My Shop or Score Basket features before relying on any matched product information
- Not submit any image to the catalogue that contains identifying information about you or any other person, and not submit nutritional data you know to be inaccurate
8 Intellectual Property
8.1 NYAM's intellectual property
All content, features, functionality, design, logos, trademarks and scoring methodologies within the App and Website are the intellectual property of NYAM App Ltd or its licensors. You may not reproduce, distribute, modify or create derivative works of any NYAM content without prior written permission.
8.2 Third-party data licences
Product data from Open Food Facts is used under the Open Database Licence (ODbL). Nutritional scoring methodology is based on publicly available research. Pesticide data is sourced from PAN UK and used for non-commercial informational purposes in accordance with their terms of use.
8.3 Your in-app content
Any content you create within the App for your own personal use — including personal notes, tags, shopping lists and the score and reason associated with a user-set score override — remains your own. You grant NYAM a limited licence to store and process this content solely to provide the App's functionality to you. Where you submit a user-set score override, anonymised data (barcode, score and stated reason only, with no personally identifiable information) may be used by NYAM in aggregate to review and improve the NYAM scoring system in accordance with our Privacy Policy.
8.4 Catalogue submissions
Where you submit a product image, a nutrition label photo or nutritional data to the public catalogue, the licence and your warranties are set out in Section 6 of these Terms.
9 Limitation of Liability
9.1 General limitation
To the maximum extent permitted by applicable law, NYAM App Ltd, its directors, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages; loss of profits, revenue, data, goodwill or business opportunities; personal injury or property damage; or any damages resulting from reliance on information provided by the App, arising out of or in connection with your use of the App, even if NYAM has been advised of the possibility of such damages.
9.2 Liability cap
Where liability cannot be excluded entirely under applicable law, NYAM's total aggregate liability to you for all claims arising in any 12-month period shall not exceed the greater of: (a) the total amount you have paid to NYAM in the 12 months preceding the claim; or (b) £500. This cap applies only to liability that can lawfully be limited. It does not apply to, and does not limit, any liability of the kind described in the final paragraph of section 9.3 (including liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law). Nothing in these Terms excludes or limits your rights under the Consumer Rights Act 2015 or other mandatory consumer-protection law.
9.3 Health and safety
The App is an information tool only and is not a source of safety, allergen or health assurance. You must not rely on the App, and to the fullest extent permitted by law NYAM gives no warranty and accepts no liability, in respect of any of the following (subject always to the final paragraph of this section):
- Reliance on food scores, nutritional data or any other information displayed in the App
- Reliance on AI-generated content including explanations, Smarter Swap suggestions, comparison recommendations and shop analysis reports
- Reliance on allergen information
- Reliance on pesticide, PFAS or additive data
- Reliance on user-set score overrides set by you or any other user
- Reliance on basket review results from the Score Basket feature
- Reliance on product-matching results from the Score My Shop or Score Basket features
- Incorrect product matching in the receipt import or basket review features
- Any inaccuracy in third-party data sources used by the App
Nothing in these Terms limits NYAM's liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded by law.
9.4 Third-party services
NYAM is not responsible for the availability, accuracy or content of third-party services integrated with the App, including but not limited to Open Food Facts, Firebase (Google), Supabase, RevenueCat, Anthropic (Claude AI) and Brevo.
9.5 App availability
NYAM does not warrant that the App will be available at all times, uninterrupted or free from errors. We reserve the right to suspend or withdraw the App at any time, with reasonable notice where reasonably practicable.
10 Indemnification
You agree to indemnify and hold harmless NYAM App Ltd, its directors, employees and agents from any reasonable and foreseeable claims, damages, losses, liabilities, costs and expenses (including legal fees) that NYAM reasonably incurs as a result of a third-party claim arising from your deliberate or negligent misuse of the App in breach of these Terms; your infringement of a third party's rights; or any content you submit to the catalogue in breach of the warranties in section 6.4. This indemnity does not apply to any loss to the extent it is caused by NYAM's own breach, negligence or other fault, and nothing in this section requires you to indemnify NYAM beyond what is fair and reasonable in the circumstances or affects your statutory rights as a consumer.
11 Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint, please contact us first at hello@nyamapp.co.uk. We will endeavour to resolve disputes informally within 30 days.
12 Changes to the App and Terms
12.1 Changes to the App
We reserve the right to modify, suspend or discontinue any feature of the App at any time, including adjusting subscription tier features and usage limits with reasonable notice. We are not liable to you for any modification, suspension or discontinuation of the App or any feature thereof.
12.2 Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or on the Website, or by email where you have provided one. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the App.
13 Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall do so.
14 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, it shall be severed from these Terms without affecting the enforceability of the remaining provisions.
15 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NYAM App Ltd regarding your use of the App and supersede all prior agreements and understandings.
16 Apple App Store — Additional Terms
This section applies where you have downloaded the App from the Apple App Store.
16.1 Acknowledgement
This agreement is concluded between NYAM App Ltd and you only, and not with Apple Inc. (“Apple”). NYAM App Ltd, not Apple, is solely responsible for the App and its content.
16.2 Scope of Licence
The licence granted to you for the App is a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
16.3 Maintenance and Support
NYAM App Ltd is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance and support services in respect of the App.
16.4 Warranty
NYAM App Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
16.5 Product Claims
NYAM App Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
16.6 Intellectual Property Rights
In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, NYAM App Ltd, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
16.7 Legal Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
16.8 Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary of it.
